Warranty

General

These warranty provisions apply to consumers.
The warranty period starts on the date of purchase of the product. The warranty period is 24 months. The warranty period is not extended by warranty work or replacement deliveries under the warranty. Keep your proof of purchase safe. Repair or replacement under the warranty applies only with the original proof of purchase. As the buyer, you must handle warranty claims and/or any complaints with the store or online store where the device was purchased.

Excluded from warranty

No warranty applies to

  1. damage caused by external influences;
  2. careless damage;
  3. improper or incorrect use, as well as incorrect operation or loading, including but not limited to the use of leaking and/or incorrectly inserted batteries and/or the use of non-original parts;
  4. incorrect setup or installation, for example by failing to observe the applicable safety regulations and/or the instructions in the user, installation and/or assembly manual(s);
  5. changes, additions and/or extensions to the device;
  6. professional use;
  7. Imperial products ordered outside the Imperial webshop. For these, you must return to the store or webshop where you purchased the relevant Imperial product;
  8. repairs and/or modifications carried out by persons or organisations other than Imperial.

The decision on the application of the warranty always rests with Imperial.

Definitions

In these warranty provisions, the following definitions apply:

  • Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with Imperial;
  • Imperial: Commaxx BV, based in Kerkrade.

Content and scope

If defects occur within the warranty period, Imperial determines whether your device will be repaired or replaced free of charge. Replacement parts or devices become the property of Imperial. Consumables, components that can be expected to need replacement during the product’s lifetime, and accessories are NOT covered by the warranty. This includes batteries, antennas, remote controls, cables, buttons, battery covers and similar accessories.

If inspection and/or repair shows that the defect was caused by improper use of the device, the warranty does not apply and we reserve the right to invoice you for the repair costs and material costs. We will contact you in advance so that you can decide on this yourself.

Make sure that you place the device in its original packaging. If this is not possible, provide suitable and sturdy replacement packaging. If the device is transported without suitable packaging, the warranty will become void. The transport risk lies with you. Do not include any extra items, such as DVDs, USB sticks or similar items. If these extra items are unintentionally lost, we unfortunately cannot accept responsibility for this.

Counterfeit products

When you purchase our products directly from Imperial or from an authorised Imperial dealer, you can be sure that you have a genuine Imperial product. Imperial’s limited warranty applies only to these genuine Imperial products purchased from Imperial or an authorised Imperial dealer.

When you purchase our products from an unauthorised Imperial dealer, the product is only covered by Imperial’s warranty if the unauthorised dealer can prove, with a detailed invoice and proof of payment, that the product was actually purchased from Imperial or an authorised Imperial dealer.

Imperial gives no warranty on counterfeit products. If you attempt to resell such products, you may be held legally liable and/or face criminal prosecution.
